(۳) The law enforcement authority shall inform the Ministry that the extension is necessary for the law enforcement authority to complete the review of its records prior to the Ministry`s decision to take custody of the child. If a child is placed in emergency detention after an incident of excessive corporal punishment and the only injury to the child is external injuries or minor bruises, other children in the home should not be placed in emergency pre-trial detention solely for injuring a child through excessive corporal punishment. However, the officer may detain other children at home in an emergency-proof manner if imminent harm to them continues to be indicated by factors, including, but not limited to, a history of domestic violence or other domestic abuse, alcohol or drug abuse, if known or obvious at the time of first contact. or other circumstances that indicate a danger to children; (a) the parent, parent or guardian does not agree in writing, in the circumstances of the arrest, that another person will take custody of the child; B) 1. If, at the time the child is admitted to emergency detention, the child is in need of emergency medical care, the official shall take the child to an appropriate health facility. Emergency medical care may be provided to the child without consent in accordance with article 63-5-350. The parent or guardian is responsible for the cost of emergency medical care provided to the child. However, the parent or guardian shall not be liable for the cost of medical examinations carried out at the request of law enforcement or the Department solely to determine whether the child has been abused or neglected, unless it is established that the child has suffered harm within the meaning of this chapter.
